摘要： 本文主要论述夫妻个人财产的婚后所生利益的权利归属，从一个实务案例出发，说明其中的归属原则，并简要介绍目前学者对个人财产婚后增值的权利归属的相关学说。指出其中《婚姻法解释三》中存在的争端问题，比如《解释三》中第5条中规定的除了孳息与自然增值为个人所有，其余的投资收益和主动增值归属于共同财产。虽然第5条的颁布解决了租金、房屋增值、红利和利息四种财产收益这些之前的司法疑难问题，它将夫妻一方个人财产的范围扩张至 孳息 和 自然增值 两个部分，上述问题迎刃而解。但是孳息与自然增值的认定又成为一大问题。这与我国传统的婚后个人财产所生孳息归属于共同所有相背离，并且单纯按照法条规定会忽略另一方对于该增值的投入。主要论述 贡献 对于增值的作用以及对最终财产的分割产生的影响。结合国外相关立法与判例，介绍在分别财产制于共同财产制下不同国家对夫妻财产的婚后增值权利归属。然后，对于《解释三》第10条关于按揭房还贷而引起的财产增值部分分割的确定。对房屋所有权的归属和增值的具体计算问题，从我国传统和时代背景相结合进行论述，并说明自我看法。最后，对于我国的立法现状提出不足与建议。

Abstract:The rights of ownership interests of students this paper mainly discusses the matrimonial personal property after marriage, starting from a real case, explain the principle of attribution, and briefly introduces the related theory of ownership of personal property after marriage scholars present value. Combined with the foreign legislation and cases, this paper introduces the marital property rights of different countries under the common property system.
